Banking Guidance
A financial institution that provides financial services to any cultivator, processor, retail dispensary, or laboratory licensed under this chapter shall be exempt from any criminal law of this state an element of which may be proven by substantiating that a person provides financial services to a person who possesses, delivers, or manufactures marijuana or marijuana derived products, including section 2925.05 of the Revised Code and sections 2923.01 and 2923.03 of the Revised Code as those sections apply to violations of Chapter 2925. of the Revised Code, if the cultivator, processor, retail dispensary, or laboratory is in compliance with this chapter and the applicable tax laws of this state.
Sec. 3796.27 (C)
“[Upon] the request of a financial institution, the department of commerce or state board of pharmacy shall provide to the financial institution all of the following information:
- Whether a person with whom the financial institution is seeking to do business is a cultivator, processor, retail dispensary, or laboratory licensed under this chapter;
- The name of any other business or individual affiliated with the person;
- An unredacted copy of the application for a license under this chapter, and any supporting documentation, that was submitted by the person;
- If applicable, information relating to sales and volume of product sold by the person;
- Whether the person is in compliance with this chapter;
- Any past or pending violation by the person of this chapter, and any penalty imposed on the person for such a violation.
The department or board may charge a financial institution a reasonable fee to cover the administrative cost of providing the information.

- No less than a whole day unit at a single time which equals:
- 1/10 of an ounce (2.83 grams) of plant material;
- 295 milligrams of THC contained in a patch, lotion, cream, or ointment;
- 110 milligrams of THC contained in an oil, tincture, capsule, or edible for oral administration;
- 590 milligrams of THC contained in oil for vaporization.
- No less than a whole day unit at a single time which equals:
- A patient and the patients caregiver(s) may collectively purchase no more than a 90-day supply as follows:
- No more than 9 ounces (255 grams) of medical marijuana.
- No more than 26.55 grams of THC content in patches for transdermal administration or lotions, creams, or ointments for topical administration;
- No more than 9.90 grams of THC content in oil, tincture, capsule, or edible form for oral administration;
- No more than 53.10 grams of THC content in medical marijuana oil for vaporization.
- A patient who is diagnosed with a terminal illness and the patients caregiver(s) may collectively purchase, within a 90-day period, no more than a 90-day supply defined as:
- No more than 10 ounces (283.50 grams) of medical marijuana.
- No more than 33.30 grams of THC content in patches for transdermal administration or lotions, creams, or ointments for topical administration;
- No more than 11.70 grams of THC content in oil, tincture, capsule, or edible form for oral administration;
- No more than 65.70 grams of THC content in medical marijuana oil for vaporization.
- Restrictions: the use of medical marijuana by smoking or combustion is prohibited but vaporization (vaping) is allowed.

- A dispensary licensee has to maintain a $50,000 bond in an “Ohio financial institution” to keep them accountable for compliance.
- Per Rule 3796:6-3 (B): A dispensary shall not sell, serve, or dispense medical marijuana at any time other than between the hours of 7am and 9pm est.
