- State municipalities may allow or prohibit licensed medical marijuana facilities and adult use establishments from operating in their municipalities.
- As of October 11, 2021, all marijuana retailers and marijuana microbusiness licensees are required to have and maintain marihuana liability insurance. The insurance must be provided by a licensed and admitted insurance company in Michigan in a minimum amount of $50,000. Marijuana retailers and marijuana microbusiness licensees authorized to sell marijuana at a temporary marijuana event must also obtain marijuana liability insurance, which covers sales or transfers of marijuana that will occur at the temporary marijuana event. Failure to hold and maintain the required marijuana liability insurance or provide it to the MRA in a timely fashion, may result in disciplinary action against the licensee. “These procedures outline the general review of credit union financial services related to the marijuana industry and related businesses/members. As the risks related to offering services in this space are varied and high, (particularly while federally illegal), the institution’s due diligence and ongoing control over such a portfolio must be robust. Examiners must evaluate management’s due diligence in deciding to provide such services. The board and management must have clear understanding of the associated risks, and satisfactory risk management tools in place which are functioning soundly.”

DIFS Issuance of Memo regarding Financial Services to the Marijuana Industry

“DIFS will review the potential impact of marijuana-related financial services on an institution’s overall risk profile as part of any examination assessment and ratings process. Examiners will continue to utilize risk-based examination procedures, and regulator expectations for the institution’s risk management functions will be commensurate with the inherent risk to the institution’s safety and soundness. DIFS will not take regulatory action based merely on the involvement of the marijuana industry in any financial institution’s products, services, or activities. However, regulatory action will result if the financial institution fails to identify, manage, account for, or provide sufficient safeguards related to the risks of marijuana-related financial products or services.”

Per the Michigan Regulation and Taxation of Marihuana Act (2018), purchase limits for adult use are:

- Oils and concentrates may be no more than 15 grams of daily total.

The MRA has authorized Designated Social Consumption Establishment licenses for marijuana consumption lounges in the state. Michigan municipalities are able to opt-out of having any kind of marijuana business in their community and only 18 municipalities out of 106 have opted-in to have Designated Consumption Establishments operating in their areas. Detroit has limited the number of Designated Consumption Establishments licenses to 35.
Per the Michigan Medical Marihuana Act (2008), purchase limits for medical patients are:

- Patients must hold a valid Medical Marijuana Card issued by the MRA. For minors under the age of 18, a parent or legal guardian must complete a MMMP Minor Application Packet.
- Each qualifying patient can have not more than 1 primary caregiver, and a primary caregiver may assist not more than 5 qualifying patients with their medical use of marihuana.

City of Detroit:
Detroit, MI has a social equity program called Legacy Detroit where applicants must meet certain requirements for recreational marijuana licenses. These requirements include:
How to apply to become a Legacy Detroiter:
To qualify for the Detroit Legacy program, you must currently reside in Detroit, and be able to document that you:
- Lived in Detroit for 15 of the last 30 years, or
- Lived in Detroit for 13 of the last 30 years and are low income, or
- Lived in Detroit for 10 of the last 30 years and have marijuana conviction or have a parent with a marijuana conviction.
Applicants will need to submit copies of documentation to certify their legacy status, such as pay stubs, tax returns, mortgage or rental lease documents, etc. Detroiters must submit a Detroit Legacy application and pay the associated fee to be certified and take advantage of the program benefits.
The application period for Legacy Detroit applicants is still open; however, a court order was issued in Summer 2021 that halted applications from being granted. The basis of the lawsuit is that the residency requirement in Detroit’s legacy program gives unfair advantage to long-term Detroit residents.
The application period for adult use licensing in Detroit resumed on April 20, 2022 after a lengthy delay.
