Key Definitions
- Adult Seasonal Resident: “any person who temporarily resides in this state for a period of at least 31 consecutive days in each calendar year, maintains a temporary residence in this state, returns to the state or jurisdiction of his or her residence at least one time during each calendar year, and is registered to vote or pays income tax in another state or jurisdiction.” Florida does not accept out of state medical marijuana cards.
- Edibles: “commercially produced food items made with marijuana oil, but no other form of marijuana, that are produced and dispensed by a medical marijuana treatment center.”
- Low-THC cannabis: “a plant of the genus Cannabis, the dried flowers of which contain 0.8 percent or less of tetrahydrocannabinol and more than 10 percent of cannabidiol weight for weight; the seeds thereof; the resin extracted from any part of such plant; or any compound, manufacture, salt, derivative, mixture, or preparation of such plant or its seeds or resin that is dispensed only from a dispensing organization.”
- Medical Marijuana Treatment Center: “A licensed medical marijuana treatment center shall cultivate, process, transport, and dispense marijuana for medical use”
Purchase Limit
- Based on “any active, valid order for low-THC cannabis, medical cannabis and cannabis delivery devices […] which was entered into the medical marijuana use registry”
- Non-smokable marijuana
- No more than a 70-day supply within a 70-day period
- Multi-serving edibles may not contain more than 200 milligrams of THC, and a single serving portion of an edible may not exceed 10 milligrams of THC.

- Smokable marijuana
- No more than a 35-day supply within a 35 rolling day period
- A 35 rolling day supply <= 2.5 ounces
- Qualified patients may only possess up to 4 ounces of medical marijuana in a form for smoking at any given time

- In a 5 to 2 decision, the Florida Supreme Court struck down a 2022 ballot initiative to allow adult use marijuana, citing improper ballot wording surrounding limited personal use of marijuana that would have mislead voters.
