Sec. 63. Not later than January 1, 2022, the Banking Commissioner, in consultation with the Commissioner of Consumer Protection, shall report to the Governor and the joint standing committees of the General Assembly having cognizance of matters relating to banking, the judiciary and finance, revenue and bonding, regarding recommended legislation to implement the provisions of RERACA, to facilitate the use of electronic payments by cannabis establishments and consumers and regarding access for Senate Bill No. 1201 June Sp. Sess., Public Act No. 21-1 100 of 303 cannabis establishments to (1) depository banking, and (2) commercial mortgages.
Sec. 64. Not later than January 1, 2022, the Insurance Commissioner shall report to the Governor and the joint standing committee of the General Assembly having cognizance of matters relating to insurance regarding access to insurance by cannabis establishments.

Adult Program Details

Adult use retail sales are not expected to being until late 2022 at the earliest. Possession of 1.5 ounces of marijuana is currently legal.

Proposed adult use purchase limits for adults 21 and older are:

42.5 grams of marijuana flower.
7.5 grams of marijuana oil and concentrate.
750 milligrams of THC in edibles or other marijuana products (not including marijuana oil and marijuana concentrate).

Social Equity

Connecticut’s Social Equity Council has identified 215 communities deemed Disproportionately Impacted Areas or areas of the state with higher drug convictions. Applicants from these areas will be prioritized for marijuana sales licenses and special equity programs. The adult use license structure will include three license types, micro-cultivator, food and beverage manufacturer and delivery that have lower barriers to entry and are designed to promote equity.

As of February 18, 2022, the Commissioner of Consumer Protection has increased the monthly allotment of medical marijuana for registered medical marijuana patients from 3.0 ounces to 3.5 ounces per month. Patients who have an allotment that has been restricted or expanded by a certifying practitioner will remain unchanged. A dispensary may dispense a portion of a qualifying patient’s monthly transaction limit not to exceed 2.5 ounces and may dispense the remaining portion at any time except that no qualifying patient or primary caregiver shall receive more than their approved monthly quantity in a one-month period.

Minors under the age of 18 may purchase medical marijuana provided the minor’s guardian/caregiver confirms palliative use of marijuana from 2 (two) physicians. One physician must be the patient’s primary care provider. The other physician must be board certified in an area of medicine involved in the treatment of the debilitating condition for which the qualifying patient will be certified. Caregivers must be 18 years or older and a physician is responsible for assessing whether the patient needs a primary caregiver.

Connecticut is a limited license state and has adult use licensing caps based on population density at a rate of one retailer and one micro-cultivator for every 25,000 residents. Additionally, municipalities can opt out of participating in the adult use cannabis sector by holding a town wide referendum. However, there is a carve out protecting pre existing medical cannabis businesses, as no existing cannabis establishments will be impacted by a vote.
